Client agrees to pay Photographer the full amount for the photography session as listed on the provided invoice. Product prices and payment will be provided at the consultation, in the welcome package and available at the ordering session.
The session fee is non-refundable deposit and must be paid within 7 days of booking the session to secure the appointment. Payment can be made via email transfer, paypal, credit card or cash. If payment is not received and there have been no alternative arrangements made with the Photographer, the Client’s reserved session time will be released. All services and products are subject to HST (13%).
Session location will be determined in advance by discussing session goals and preferred style. Private properties can only be used if permission is granted by the owner.
If session location is beyond 35km from Photographer's Office, a travel fee may apply ($0.60/km). Travel fee must be paid 24hrs before session date/time.
Client agrees not to disclose session location or photographer's process and/or techniques to any 3rd party.
The Photographer will be the only photographer at the photo session. No other cameras (including cell phones) or videotaping are permitted. The Photographer will not continue if there are other cameras or videotaping during the session.
If the Client needs to reschedule, a 24 hour notice is required. The Photographer retains any payment made if the Client does not provide 24 hour notice and is not obligated to provide a rescheduled session. In the event of extreme and unfavourable weather (i.e. downpour, storm, extreme cold) the session will be postponed until a later and mutually-decided date is determined. The decision to postpone a session due to weather must be determined a minimum of 4 hours before the session time. The Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond her control. In such circumstances, the Client will be fully reimbursed or is permitted to reschedule without penalty.
No refund will be issued in the event of a no-show on behalf of the Client or if the Client is more than 15 minutes late to a session without notice. Equally, there will be no refund for lack of Client cooperation. The Photographer reserves the right to end the session when she feels there are enough images or variety there of, or due to lack of cooperation; no refund will be issued for unused time.
The Client allows the Photographer complete creative control in terms of poses (or lack thereof), props, location and processing.The extent to which an images is edited is at the sole discretion of the photographer. Temporary attributes such as bruises, blemishes or scratches will be removed in post-processing. Subjective attributes and those controllable by the Client (i.e.; wrinkled clothing, lint, logos, cosmetic factors) will be at edited at the Photographer's discretion. An additional fee may be required for extra edits. Raw images (unedited) will not be released under any circumstances.
A sneak peek will be posted on Facebook within 48 hours of the session date/time. Within 10 days of the photo session, the Client will be able to view and order their photos and products at our office. At the ordering session, the Client will be able to view all the professionally processed images as well as sample products from which to choose. Products, prints and/or images must be purchased and paid for during the viewing and ordering session therefore it is recommended that all decision makers attend the session. Additional ordering sessions can be schedule for $100 per session.
Prints and products are ready for pick-up or delivery between 1-4 weeks from the time of order. If additional production time is required, the Photographer will advise the client in advance. Rush orders, if available, can be processed at an additional fee.
The Photographer has the right to use and publish images and photographs taken during your photography session to further promote its service, including portfolio, website, display, advertisement, and editorial use. The Client agrees that they will not be compensated. If the Client prefers to keep their images private, this must be discussed with the Photographer prior to the session. The names and ages (for those under 18 years old) of session participants must be listed in the questionnaire.
Michelle Ma Belle Photography retains all copyright to the images created during the session. The images provided to the Client are for any reasonable personal purposes, including but not limited to: printing, copying, emailing, and web publishing. A print release will be provided to the Client for personal printing purposes. These images will not be watermarked. The print release does not allow publication of your portraits (i.e. entering into contests), selling or altering your images without the Photographer's permission. Portraits and digital images may not be scanned, copied, edited, or reproduced in any way. Violations will be subject to civil and criminal penalties.
Clients are permitted to share their purchased images on social media at their own discretion. Images specifically re-sized and modified for web sharing can be provided for this purpose. The images posted by the photographer on social media are not to be altered and the watermark must not be removed; they can be tagged and shared. Clients are not permitted to copy and save these images to their desktop or mobile devices.
All orders must be paid in full at the ordering session, which takes place within two weeks of the portrait session. Payment can be made by Paypal, e-transfer, cash, cheque or credit.
Prints and products are ready for pick-up or delivery between 1-4 weeks from the time of order. Some products may require additional production time. Rush orders, if available, can be processed at an additional fee.
Clients will be notified by email when order is ready for pick up. A delivery fee may apply if you are not able to pick-up your order. Free delivery within the Findlay Creek Community.
The Photographer will review your orders before pick-up for quality assurance.
All orders are final.
After the session, the Photographer will review and sort images for quality purposes. Any images that do not meet her standard of quality will be discarded. After 30 days, Client images will be archived. All ordered images are kept on file for one year.
The Photographer is responsible to produce images that are consistent with her portfolio. The Photographer is honest in terms of her photography skills and abilities, therefore quality images which meet her current standards are guaranteed. Refunds or re-shoots are only offered in the event of a technical malfunction (equipment, storage, etc..) and not due to creative differences.
The Photographer makes every reasonable effort to secure the original session date and time. In the case of a severe medical, natural or other emergency, it could be necessary to postpone the session date.
The Photographer takes utmost care of their equipment and files. In the unlikely event that images are damages, lost or stolen, the Photographer is only responsible to return al monies paid to date. The limit for partial loss of files shall be prorated based upon the number of files lost vs the total number of files.
The Photographer is not responsible for output of prints that are not ordered through the Photographer.
The Photographer is not responsible for any injury to the Client or Client's photographic party. Clients will be responsible for their children and themselves and release the Photographer from any claims.
The Client agrees to relay details of this contract in full to any and all subjects participating in the session.
The electronic signature shall have the same effect as an original signature.
